Police bodycam footage obtained by Fox News Digital captures Oklahoma Secretary of State Benjamin Lepak’s arrest outside a McDonald’s in Edmond on Friday night following a public intoxication complaint. Officers responded to the location around 10:45 p.m. after receiving a report of an intoxicated man in the area and discovered Lepak near the restaurant’s drive-thru window with his vehicle parked in the lot.
According to the arrest affidavit, Lepak exhibited signs of intoxication including slurred speech, an alcoholic odor on his breath, and difficulty retrieving his identification. Officers noted he struggled to maintain a coherent train of thought during questioning about his location, alcohol consumption, and arrival at the establishment.
Lepak initially claimed he had consumed only one beer during a church gathering with other fathers earlier that evening, later asserting he had consumed less than a full beer. The affidavit indicates he made conflicting statements regarding whether he drove to the McDonald’s, according to police allegations.
A spokesperson for Lepak stated he was simply waiting outside the restaurant for dinner and emphasized that no breathalyzer test was administered. The official said Lepak would address the citation through the appropriate legal channels.
Oklahoma Attorney General Gentner Drummond called for Governor Kevin Stitt to immediately terminate Lepak, characterizing his conduct as unbecoming of a high-ranking state official. Drummond noted that Lepak had been arrested years earlier following discovery in a running vehicle and questioned Stitt’s judgment in elevating him to the position.
Stitt appointed Lepak as secretary of state in October 2025 after serving in roles as the governor’s general counsel and executive director of the State Chamber Research Foundation.
