Allison Roberts filed a federal lawsuit Wednesday against Portland Public Schools and Meriwether Lewis Elementary School, claiming officials retaliated against her for publicly opposing the district’s gender identity curriculum. The Liberty Justice Center, representing Roberts, alleges the school violated her constitutional rights to free speech and due process after she voiced concerns about curriculum changes and school policies.
Roberts initially objected last year when the school replaced its traditional rainbow pride flag with an “Intersex-Inclusive Progress” variant, which she contended promoted transgender ideology inconsistent with her Christian beliefs. Her concerns deepened after discovering an “identity flower” assignment requiring her 11-year-old child to discuss gender identity with classmates and teachers, citing a lack of prior parental notification.
Following an unsatisfactory response from school administration, Roberts distributed an open letter criticizing the policies from a public sidewalk outside school property. The school subsequently issued her a one-year trespass order after a confrontation with another parent, prohibiting her attendance at school events including her child’s graduation and citing alleged “harassment, intimidation, and threatening behavior.”
The Liberty Justice Center contends the trespass order and school policies violate Roberts’ First and Fourteenth Amendment rights. The organization is seeking a federal court declaration that the school’s actions are unconstitutional and requesting a preliminary injunction to block enforcement while the case proceeds.
Timothy R. Snowball, senior counsel at Liberty Justice Center, stated the organization plans to file a motion for preliminary injunction to halt what it describes as unconstitutional policies affecting multiple families in Portland. Portland Public Schools declined to comment on the ongoing litigation.
Roberts told Fox News Digital that she has received substantial community support for her legal challenge. She emphasized that her lawsuit extends beyond her family’s circumstances, stating she is fighting on behalf of American families nationwide concerned about school gender policies.
