The New York state murder trial for Luigi Mangione has been postponed until December after his legal team filed a motion to dismiss charges stemming from his recent guilty plea on federal counts. Jury selection was originally scheduled to begin September 8, but the federal guilty plea prompted the defense to raise constitutional protections against double jeopardy that could complicate the state prosecution.
Judge Gregory Carro’s order, released Monday, set a timeline for the competing motions. Prosecutors have until October 9 to file their response to the dismissal motion, with Mangione’s defense team permitted until October 30 to submit their reply. The judge scheduled the next court date for December 10.
The 28-year-old University of Pennsylvania graduate pleaded guilty Friday in federal court to stalking and killing UnitedHealthcare CEO Brian Thompson, 50, a Minnesota father of two. Mangione admitted to following Thompson across state lines before shooting him in the back outside a Manhattan hotel in November where Thompson was scheduled to meet with investors.
New York’s double jeopardy protections under state law differ from federal constitutional standards, providing a potential advantage to Mangione now that his federal case has been resolved. Despite this legal obstacle, Manhattan prosecutors have indicated they intend to pursue the state charges. If convicted on the top count of second-degree murder, Mangione faces a maximum sentence of 25 years to life in prison, though he has not yet been sentenced in the federal case where guidelines suggest approximately 30 years maximum.
