The U.S. Attorney for the District of Columbia, Jeanine Pirro, on Friday dismissed charges against David Hearn, a former Olympic athlete who faced a decade in prison for allegedly damaging the Lincoln Memorial Reflecting Pool. The decision came after additional documentation revealed that deterioration of the pool’s new sealant resulted from faulty contractor installation rather than intentional vandalism.
Hearn had been accused of removing portions of sealant applied during President Donald Trump’s ongoing renovation of the iconic Washington monument. The defendant maintained he was simply examining preexisting damage visible on the structure, characterizing his actions as curiosity rather than deliberate sabotage.
Pirro’s prosecutorial judgment stands in contrast to previous Justice Department handling of January 6 and protest-related cases, according to observers. The reversal underscores how maintenance issues at the reflecting pool—historically associated with the Rev. Martin Luther King Jr.’s 1963 “I Have a Dream” speech—have become entangled in broader partisan political disputes.
Challenges with the reflecting pool’s upkeep are not unprecedented. The Washington Post reported in 2012 that the structure required draining to remove algae growth during the Obama administration, suggesting persistent maintenance difficulties independent of recent renovation efforts.
Trump’s capital beautification initiative, which included National Guard deployment, has generated both support and criticism. The reflecting pool repairs have become emblematic of deeper political divisions, with observers on both sides interpreting construction setbacks through ideological lenses.
