Republican Massie Sides With Democrats in Lawsuit Push Against Trump Over Iran Military Operations

Kentucky Republican Rep. Thomas Massie has joined with House Democrats in sponsoring a resolution that would force Speaker Mike Johnson to pursue legal action against the Trump administration over military operations in Iran. The bipartisan legislative effort marks a rare alignment between Massie and Democratic lawmakers who argue the president is operating without proper constitutional authority. The resolution names Johnson, R-La., as the defendant in what would be an unprecedented lawsuit against the sitting administration.

Leading the Democratic contingent are Rep. Gregory Meeks of New York, the top Democrat on the House Foreign Affairs Committee, alongside representatives Jim McGovern of Massachusetts, Gabe Amo of Rhode Island, Pramila Jayapal of Washington, Jason Crow of Colorado, and Ro Khanna of California. The effort challenges what the lawmakers characterize as violations of the 1973 War Powers Resolution by Trump and Pentagon chief Pete Hegseth.

Massie asserted that the Trump administration has disregarded a concurrent resolution that passed in accordance with the War Powers statute and has misinterpreted the 60-day limitation on presidential military action by claiming the clock restarts with each temporary ceasefire. He argued the administration appears to assume the law is unconstitutional despite no court ever reaching such a conclusion. The lawmaker contended that litigation is necessary to establish judicial clarity on the matter.

Massie was among four House Republicans who voted last week with Democrats to pass a war powers resolution rebuking Trump over Iran operations. While that measure proved largely symbolic with no binding effect, his vocal criticism of the president drew a primary challenge backed by Trump, ultimately resulting in Massie’s defeat by Trump-endorsed candidate Ed Gallrein.

Speaker Johnson has declined to commit to supporting an Authorization for Use of Military Force regarding Iran, stating instead that the administration should work toward resolution of the conflict. He told reporters Tuesday he did not believe such authorization was necessary at the current time. The new lawsuit resolution faces significant obstacles to a full House floor vote without procedural maneuvers from Massie or Democratic leadership to overcome Republican opposition.

Massie criticized Johnson for allowing institutional power to diminish through inaction, noting that previous conflicts in Iraq and Afghanistan were authorized through formal congressional measures. The Trump administration, Massie stated, has sought no such authorization for the Iran conflict and is therefore operating outside constitutional bounds. The White House has not yet responded to requests for comment on the proposed lawsuit resolution.
