New York City Mayor Zohran Mamdani introduced a new Unified Court System on Tuesday designed to accelerate emergency housing court proceedings when the health and safety of residents face imminent danger. The initiative aims to compress timelines for tenants seeking relief from landlord negligence, reducing delays that have historically prolonged disputes over habitability violations and maintenance failures.
The expedited track will prioritize cases meeting specific criteria, including buildings where at least one-third of units carry open vacate orders, properties from which families have been displaced, or structures with one-third of units containing active and immediately hazardous violations affecting essential services. In instances involving persistent and extreme negligence where tenants demand complete building management replacement, the system mandates parties return to court within five days after service completion, Mamdani announced.
When pressed on distinguishing between chronically negligent landlords and those struggling financially with maintenance obligations, Mamdani drew a firm line. He emphasized that all property owners must comply with housing law regardless of circumstances, stating that operators unable to meet legal requirements “should not be a landlord” of the property in question.
The mayor acknowledged gaps in enforcement remain, particularly regarding landlord compliance with court appearances during the accelerated timeline. His office declined to detail specific mechanisms for compelling adherence to the five-day mandate.
