A Nevada judge has dismissed the long-running criminal case against six state Republicans who faced allegations of submitting a forged certificate claiming Donald Trump won Nevada’s 2020 presidential election, according to a ruling issued Thursday. The decision represents another significant legal defeat for prosecutors pursuing fake elector cases across multiple swing states that attempted to reverse Trump’s loss to Joe Biden.
Nevada Attorney General Aaron Ford, a Democrat seeking his party’s gubernatorial nomination, had filed forgery and false document charges against the six defendants, all of whom entered not guilty pleas. Ford’s office announced plans to pursue an appeal of the dismissal, which came after Judge Mary Kay Holthus determined insufficient evidence existed to prove the electors intended to deceive government agencies.
The defendants included Michael McDonald, Nevada Republican Party chair, and Jesse Law, former Clark County Republican Party chair. Following the November 2020 election, the group gathered outside the state legislature to sign a certificate awarding Nevada’s six electoral votes to Trump, despite Biden’s victory margin exceeding 30,000 votes in the state.
Holthus found prosecutors failed to establish fraudulent intent, noting the defendants openly publicized their actions rather than concealing them. The defense characterized the certificate submission as political theater intended to preserve legal challenges to election results. The judge also determined the state withheld exculpatory evidence from the grand jury.
Comparable fake elector cases have been dismissed in Arizona, Georgia, and Michigan. A federal prosecution of Trump related to alleged election conspiracy was abandoned in late 2024 following his 2024 victory over Vice President Kamala Harris. Wisconsin’s fake elector case remains pending.
