Federal immigration authorities have secured a detainer against a 19-year-old Salvadoran national accused of allowing a toddler to drown while in his care in North Carolina. Angel Israel Deras-Rivas, arrested Sunday in Garner, faces murder and felony child abuse charges stemming from the death of his 14-month-old stepchild in a bathtub.
The child died after Deras-Rivas allegedly left the toddler unattended in a water-filled bathtub, according to documents obtained by The Raleigh News & Observer. The incident occurred months after Deras-Rivas married the child’s mother in April, officials said.
Immigration and Customs Enforcement filed the detainer with the Wake County Sheriff’s Department on the day of arrest, requesting that state officials notify the agency before any release and maintain custody for up to 48 hours beyond scheduled release dates. This mechanism allows ICE time to assume federal custody for removal proceedings.
Federal authorities say Deras-Rivas unlawfully entered the United States through Texas in October 2023 and was subsequently released into the country under Biden administration policies. DHS Secretary Markwayne Mullin stated the case exemplifies consequences of what he characterized as lax border enforcement measures.
