Sen. Tim Kaine, D-Va., has formally challenged the Trump administration’s maritime enforcement campaign in the Americas, asserting that classified military operations have resulted in deaths of individuals unconnected to drug trafficking. In an Aug. 3 letter to President Donald Trump, Kaine characterized the fatalities as murder, raising fundamental legal and ethical concerns about the program’s execution.
The administration launched a series of boat strikes beginning in September 2025 following a July directive from Trump ordering the Department of Defense to conduct kinetic operations against alleged narcotraffickers in international waters. A Department of Justice Office of Legal Counsel opinion issued that same month provided legal justification for the strikes, provided certain undisclosed factual conditions were met. Kaine emphasized that both the targeting criteria and the legal conditions remain classified, leaving affected parties unaware they face potential attack.
White House spokesperson Anna Kelly responded to the accusations by emphasizing Trump’s campaign pledge to confront drug cartels, stating that strikes have targeted only “designated narcoterrorists” responsible for deaths of American citizens. The Pentagon did not immediately comment on the senator’s allegations.
Kaine’s analysis of available documentation—including Trump’s July directive, the classified Justice Department opinion, and Department of Defense implementation orders—concluded that actual strikes exceeded the legal scope authorized by the administration. The Virginia Democrat, who has served in the Senate since 2013 and was Hillary Clinton’s vice-presidential running mate in 2016, called for a full investigation into whether Pentagon leadership overstepped presidential authority and demanded an immediate halt to the operation.
