According to the police report, Zach Hickerson appeared emotionally distressed while emergency responders attempted resuscitation, whereas Brian Hickerson did not display visible emotion until after Panettiere was pronounced dead. Authorities received a bag of medication from Hickerson that Panettiere had allegedly been taking.

Records obtained indicate that Hickerson traveled with Panettiere from Los Angeles to the South Carolina apartment complex the day before she was found unresponsive. The pair had briefly separated in 2022 before reconciling the following year, with Zach Hickerson confirming to police that his brother was in a romantic relationship with the actress at the time of her death.
