Former National Institute of Allergy and Infectious Diseases Director Anthony Fauci has rejected an invitation to testify voluntarily before a Senate subcommittee on investigations, according to correspondence filed Friday. The refusal came one week after the Republican-controlled Homeland Security Committee approved a contempt measure against the infectious disease specialist on largely party-line votes.

Through his legal counsel, Fauci informed Wisconsin Republican Ron Johnson, who chairs the investigations subcommittee, that any compelled appearance would constitute improper harassment on political grounds. The decision follows a contentious July 29 hearing during which Fauci invoked Fifth Amendment protections against self-incrimination approximately 100 times while discussing his pandemic management.

The August 6 contempt vote triggered a referral to the Department of Justice for potential investigation into whether Fauci properly exercised his constitutional rights. Kentucky Republican Rand Paul, who spearheaded the contempt effort, argued the Fifth Amendment protection was moot because President Joe Biden had preemptively pardoned the former health official.

Paul has repeatedly alleged Fauci misled the public during the pandemic and has called for criminal prosecution and imprisonment. Johnson sought to establish a separate congressional investigation into Fauci’s pandemic response role, including vaccine safety and effectiveness assessments.
