A surrogate who relocated to Texas delivered a newborn boy diagnosed with hypoplastic left heart syndrome despite requests from the biological parents that she terminate the pregnancy. McKenna West traveled to the state after receiving the fetal diagnosis around 20 weeks of gestation, according to a statement released Tuesday by Texas Attorney General Ken Paxton’s office.
Paxton moved to safeguard the infant’s medical treatment by formally alerting UT Southwestern Medical Center and Children’s Medical Center of Dallas regarding their legal obligations to deliver “medically necessary, life-saving care upon birth.” The intervention came after the biological parents declined to authorize surgical intervention for the condition, his office indicated.
Born on Wednesday and named Gabriel, the newborn was admitted to a neonatal intensive care unit for preparation of emergency surgery. The medical facility performing the procedure maintains a 100 percent success rate for the operation, according to reporting by Fox News.
“Baby Gabriel deserves a chance at life, and I will not allow anyone to unlawfully deny him medically necessary care,” Paxton said in the statement. “My office will use every tool available to protect innocent lives and ensure that every child receives the care required under Texas law.”
