Attorneys representing Alex Murdaugh filed a motion Wednesday requesting that prosecutors conduct a comprehensive search for evidence that could benefit the defense or weaken the state’s case as the disgraced lawyer prepares for retrial. The filing argues that sufficient time has elapsed since the initial trial to warrant a fresh examination of materials that prosecutors are obligated to disclose under discovery rules.
The defense team specifically seeks access to information that could be used to impeach witness testimony, including personnel misconduct records, disciplinary actions, prior inconsistent statements, plea agreements, and any promises of leniency or favorable treatment. Additionally, the motion requests any new forensic findings, DNA analysis results, supplemental search warrants, and materials related to two separate South Carolina Law Enforcement Division investigations referred to as the “Side of Road” and narcotics cases.
Murdaugh’s legal team has demanded written certification that prosecutors have completed their search and fulfilled all disclosure obligations, setting a 30-day deadline for the state to provide the requested materials. The retrial comes after the South Carolina Supreme Court reversed Murdaugh’s March 2023 murder and weapons convictions due to judicial misconduct by court clerk Rebecca Hill, who the court found was influenced by the “siren call of celebrity” during jury proceedings.
Murdaugh, a former prominent South Carolina lawyer, was originally convicted of murdering his wife Maggie and son Paul. The former attorney is scheduled to appear in court Friday, August 14.
